W dniu 22.10.2020 r. Trybunał Konstytucyjny orzekł, że  art. 4 a ust. 1 pkt 2 ustawy z dnia 07.01.1993 r. o planowaniu rodziny, ochronie płodu ludzkiego i dopuszczalności przerywania ciąży, pozwalający na dokonywanie aborcji w sytuacji, gdy badania prenatalne lub inne przesłanki medyczne wskazują na duże prawdopodobieństwo ciężkiego i nieodwracalnego upośledzenia płodu albo nieuleczalnej choroby zagrażającej jego życiu, są niezgodne z Konstytucją Rzeczypospolitej Polskiej.

Komisja Praw Człowieka Krajowej Rady Radców Prawnych stoi na stanowisku, że rozstrzygnięcie to urąga zasadom współczesnego społeczeństwa demokratycznego i państwa prawnego. Komisja ze zdecydowaną dezaprobatą przyjmuje, że Trybunał Konstytucyjny odnosząc wartości konstytucyjne do sytuacji płodu całkowicie zignorował prawa kobiet, w tym prawo do godności i wolności osobistej. W ten sposób potraktował ciężarne kobiety w sposób całkowicie przedmiotowy, odmawiając im podstawowych praw. Konsekwencją takiej decyzji będzie narażenie kobiet na ogromne, traumatyczne cierpienia fizyczne i psychiczne, co samo w sobie należy uznawać za nieludzkie i poniżające traktowanie, wbrew zobowiązaniom Polski wynikającym m.in. z Europejskiej Konwencji o Ochronie Praw Człowieka i Podstawowych Wolności oraz innych wiążących aktów prawa międzynarodowego.

Przedmiotowe rozstrzygnięcie jest tym bardziej dyskusyjne, że zostało wydane przez skład orzekający obejmujący sędziów, których bezstronność i niezależność budzą poważne, uzasadnione wątpliwości. Trudno więc przyjąć, aby ich decyzja była całkowicie samodzielna i niezawisła. Wątpliwa jest również legitymacja formalna części składu do wydawania prawnie wiążących orzeczeń Trybunału Konstytucyjnego. Orzeczenie nie było poprzedzone żadną formą publicznej dyskusji, tj. debatą parlamentarną lub społeczną, co przy tak drażliwym zagadnieniu wydaje się absolutnie konieczne. W ocenie Komisji, wykreowanie przez Trybunał nowego przestępstwa, polegającego na dokonaniu aborcji w sytuacji, która uznawana była przez ponad 20 lat za legalną, jest jaskrawo sprzeczne z rolą sądu konstytucyjnego jako negatywnego ustawodawcy. Komisja stoi także na stanowisku, że przesunięcie ciężaru decyzji z parlamentu na Trybunał Konstytucyjny, bez odbycia konsultacji społecznej, zasięgnięcia opinii lekarzy, w czasie szalejącej epidemii COVID-19, jest naruszeniem fundamentów demokratycznego państwa prawnego, co wzbudziło zrozumiały niepokój społeczny.

W trosce o zdrowie i życie kobiet, mając także na względzie prawa dziecka do życia i zdrowia, Komisja Praw Człowieka Krajowej Rady Radców Prawnych wzywa władze publiczne do odejścia od arbitralnych rozwiązań i podjęcie debaty publicznej z udziałem różnych środowisk, a przede wszystkim z udziałem kobiet, których prawa orzeczenie Trybunału Konstytucyjnego drastycznie i niesprawiedliwie narusza.

Statement of the Human Rights Committee

of the National Bar of Attorneys at Law

concerning the Constitutional Tribunal ruling of 22 October 2020.

On 22 October 2020 the Constitutional Tribunal ruled that the provisions of Article 4a(1)(2) of the Act on Family Planning, Human Embryo Protection and Conditions of Permissibility of Abortion, permitting abortions in a situation in which prenatal examinations or other medical conditions indicate that a high probability of a severe and irreversible fetal defect or an incurable illness that threatens the fetus’ life exists, are unconstitutional.

The Human Rights Committee of the National Bar of Attorneys at Law is of the opinion that the aforementioned ruling undermines the values of a modern democratic society and the rule of law. The Committee strongly disapproves of the fact that when relating constitutional values to the situation of a fetus, the Constitutional Tribunal has completely ignored the rights of women, including their right to dignity and personal freedom. By issuing its ruling, the Constitutional Tribunal treated pregnant women as objects, refusing to respect their fundamental rights. The decision that has been made means that women will suffer enormous physical and mental trauma, which in itself may be considered inhuman and humiliating treatment that violates Poland’s obligations under the European Convention for the Protection of Human Rights and Fundamental Freedoms, as well as under other binding international laws.

The ruling in question gives even more grounds for dispute, as it has been issued by a panel including judges whose independence and unbiased approach are seriously questioned, and justifiably so. It is difficult to assume that their decision was fully independent and sovereign. The formal legitimacy of some of the judges to issue legally binding rulings of the Constitutional Tribunal is dubious as well. The ruling was not preceded by any form of public discussion, i.e. a parliamentary or a social debate that seems to be absolutely necessary, as the issue at hand is of an extremely delicate character. In the opinion of the Committee, the Tribunal’s definition of a new offense that consists in performing an abortion in a situation that has been considered, for over 20 years, to be legal, clearly contradicts the role of a constitutional court which acts, instead, in the capacity of a negative legislator. The Committee is also of the opinion that transferring the burden of the decision form the Parliament to the Constitutional Tribunal, without any social consultations being held and without doctors’ opinion being sought during the peak of the COVID-19 pandemic undermines the foundations of a democratic state of law and has understandably led to social unrest.

Expressing our concern for the health and lives of women, and also considering the rights of children to live and to be healthy, the Human Rights Committee of the National Bar of Attorneys at Law hereby calls upon the public authorities to withdraw from arbitrary solutions and to initiate a public debate with the participation of various circles – and most importantly of women – whose rights have been drastically and unfairly violated by the ruling of the Constitutional Tribunal.
